INITIAL STATEMENT
In the event of a conflict between this agreement and any other terms and/or conditions, the terms and conditions of this agreement will take priority.
DEFINITION OF TERMS
AGREEMENT (THE AGREEMENT) means all clauses, terms, conditions, obligations and practices further referenced in this document.
COMPANY (THE COMPANY) means the privately-held enterprise by the name of Earnfromsurveys.com, its online resources, websites, affiliate programs and tools.
WEBSITE (THE WEBSITE) means the website under the URL of http://www.earnfromsurveys.com/ and all pages within the domain of the same name.
WEBSITE TERMS OF USE means the terms and conditions hereby listed with regards to the utilisation of the website.
PRIVACY POLICY means the company’s own policies regarding contractor’s privacy, including cookies policy and personal data use. More information on the company’s policies can be found in the company’s privacy policy section.
INTELLECTUAL PROPERTY RIGHTS refers to all trademarks, copyrights, terms and conditions used throughout the website, with regards to the company and all trademarks, copyrights, terms and conditions with regards to all third persons involved in the company belonging to their respective owners.
CONTRACTOR (THE CONTRACTOR) means the person who has agreed to comply with the terms and conditions hereby listed and who has successfully registered an account with the company through the website.
CONTRACTOR ACCOUNT means the account the contract creates on the website with the company by adhering to all conditions referenced in this document.
PAYMENT THRESHOLD means the minimum balance acquired by the contractor through his/her ongoing rewards accumulated via the completion of surveys and/or any projects advertised by the company on the website. The payment threshold will be defined throughout the website.
PAYMENT POLICY means the manner in which the company pays the contractor for his/her activity on the website. At the point of reading this document, the payment policy is that the company pays the contractor via PayPal.
THIRD PERSON means any third-party company that the company has partnered with to provide jobs and/or surveys.
SURVEY means an online questionnaire advertised on the website by a third-party vendor (third person).
SUCCESSFUL COMPLETION OF SURVEY (VALID SURVEY) means that the third persons the company partners with have verified that the survey completed by the contractor has been so in a legitimate manner and has been registered in the third person’s system.
UNSUCCESSFUL COMPLETION OF SURVEY (INVALID SURVEY) means that the third persons the company partners with have NOT verified the survey completed by the contractor. The third persons the company work with reserve any rights to reject surveys completed by the contractor of the company, and the company does NOT have any responsibility and/or obligations to the contractor.
SURVEY REWARD means the reward the contractor will receive from the company upon successful completion of survey.
THE SYSTEM means the tracking and survey recording system that the company uses to track and record the contractor’s survey activity (clicks and completions).
PAYPAL refers to the online transaction system with website http://www.paypal.com/.
PAYPAL EMAIL ADDRESS means the email address used for registering an account with PayPal.
COMPANY EMAIL ADDRESS refers to the company’s contact email address: support@earnfromsurveys.com
CONTRACTOR BALANCE means the balance in pounds sterling that the contractor has accumulated via completing surveys and/or projects on the website. The contractor balance will be shown on the relevant pages within the website.
PERSONAL INFORMATION means the contractor’s personal details necessary for registration and survey/job completion, as required by third persons.
CONDITIONS, RIGHTS AND OBLIGATIONS
- The company allows you to earn money via completing surveys and/or other projects defined in this page.
- Each survey has a given reward attached to it which is the reward the company agrees to pay the contractor upon successful completion of the survey.
- In the event of an unsuccessful completion of a survey, the company will NOT pay the contractor the amount for that particular survey.
- In the event of an unsuccessful completion of a survey, the company will NOT have any responsibilities or obligations toward the contractor in question.
- The company will NOT pay the contractor for surveys, jobs or projects done outside of the website or directly with the third persons the company partners with.
- All surveys completed by the contractor on the website are tracked and recorded in the company’s system provided by its third persons. In the case of a survey NOT being recorded or recognized by the system, the company agrees to contact the third persons it works with to verify that the survey has not been recorded in their systems either. If the survey has been recorded as valid by the third person’s system, the company agrees to recognize that survey as valid and pay the contractor only the amount that has been previously attached to that particular survey, no additional compensation will be made to the contractor. However, in the case of that survey not being recognized as valid (in other words, it is seen as invalid), the company will NOT pay the contractor the reward associated with that particular survey.
- All valid completions of surveys and/or projects will be reflected in the contractor balance, shown on the relevant pages on the website. The contractor balance is the amount that the contract has in his/her account at any given point. The contractor balance is the balance of all valid survey/project completions.
- The company pays all its contractors via PayPal only when the payment threshold has been reached by the contractor.
- The company will pay the contractor the amount equal to the minimum threshold AUTOMATICALLY within 24 hours of the accumulation of the payment threshold. There is nothing to be executed on the contractor’s part regarding payment, ECXEPT:If the contractor has not received payment within 24 hours of him/her reaching the payment threshold on the website, he/she MUST contact the company at: support@earnfromsurveys.com immediately. The company has legal obligation to pay the contractor his/her accumulated contractor balance (given the payment threshold has been reached) within 48 hours of contacting the company on the company’s email address.
- The contractor agrees to provide an accurate PayPal email address, associated with his/her PayPal account. That PayPal email address MUST be used for registration on this website (with the company).
- The company will NOT pay the contractor if he/she has provide an incorrect PayPal email address (i.e. the contractor has used an invalid/incorrect PayPal email address when registering an account with the company).
- The contractor agrees that the survey reward for a particular survey may not be the same across all contractors and that the company reserves the right to offer higher/lower compensation to more active/inactive users upon so decided by the company.
- The company reserves every right to change the survey rewards depending on the conditions of its third persons and upon self-made decisions. The contractor will NOT and CANNOT hold the company responsible for a change in survey rewards.
PERSONAL DETAILS / DATA PROTECTION
By adhering to these terms and conditions, you agree to dispose of you personal information for research and data collection purposes. The personal details provided by the contractor will NOT be visible and/or used by the company in anyway, apart from the contractor’s PayPal email address, which will be used to pay the contractor for his/her valid survey/project activity (give they are valid) and once the payment threshold is reached.
The contractor agrees to dispose his/her personal information within the survey completion process for the company’s third persons research purpose. The contractor personal details will not be used for any other purpose, according to our third persons’ terms and conditions.
COMMUNICATION
The contractor agrees that the company may contact him/her from time to time regarding his/her account and/or current live surveys/project. In the case of the contractor wishing to terminate this communication, he/she must contact the company at the company email address and the company will terminate the communication.
GOVERNING LAW AND JURISDICTION
The agreement and any disputes, conflicts or claims arising out of or in connection with the contract or its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the law of England.
The parties irrevocably agree that the courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the agreement/contract or their subject matter or formation (including non-contractual disputes or claims).
INDEPENDENT CONTRACTOR CLAUSE
The contractor is an independent contractor and is not authorized to make any kind of representations or commitments to other third parties on behalf of the company or our third persons. This agreement herein outlined does not create an employer-employee or agency relationship. This agreement shall NOT render the contractor an employee, worker, agent, or partner of the company and you shall not hold yourself out as such.
FRAUDULENT ACTIVITY
In the case of the company suspecting fraudulent activity on the part of the contractor, the company WILL TERMINATE his/her account and all terms associated with this will be as per the agreement/account/contract suspension/termination clause on the part of the company outlined below this point.
AGREEMENT/ACCOUNT/CONTRACT SUSPENSION/TERMINATION CLAUSE
The contractor agrees that the company reserves every right to suspend/close/terminate the contractor’s account on the website without specifying a reason for so doing. In the event of account termination, the company will NOT pay the contractor any compensation or the contractor balance.
The company agrees that the contractor may wish to terminate his/her account. To do so, the contractor must send an email to the company email address requesting for his/her account to be closed. All payment conditions will still be obliged to by the contractor and he/she will NOT be paid his/her contractor balance unless minimum payment threshold has been reached and there is no suspicion of any kind of fraudulent activity on the contractor’s part.
FINAL STATEMENTS
This agreement is a contract. By registering an account with the company, the contractor agrees to recognize this agreement as a contract and abide by its terms and conditions.
By registering an account with the company, the contractor agrees to have read the privacy policy of the company.
By registering an account with the company on the website, the contractor and the company agree to the terms, conditions, rights and obligations herein outlined, before and after this point in this document.
By registering an account with the company, the contractor agrees to oblige to the terms and conditions herein outlined, before and after this point in this document, and also agrees to oblige to the terms and conditions of our third persons.
By registering an account with the company, the contractor agrees to take into account that the terms and conditions herein outlined, before and after this point in this document, are subject to change and that the company reserves all rights to change these terms and conditions, with regards to: payment policy, payment threshold. Any change to the terms and conditions will NOT be communicated with the contractor.
